Former Home Contractor Brandon M. Middaugh Indicted on Multiple Counts of Felony Theft

Concord, NH – Attorney General John M. Formella announces that the Hillsborough County Grand Jury – Northern District has returned eight indictments charging Brandon M. Middaugh, age 32, with four class A felony counts of Theft by Misapplication of Property and four class A Felony counts of Theft by Unauthorized Taking or Transfer.

Middaugh was charged with four counts of Theft by Misapplication of Property alleging that he took over $1,500.00 in relation to four separate construction projects, upon agreement or subject to a known legal obligation to make a specified payment or distribution to a third person, and recklessly failed to make the required payment or disposition and dealt with the money as his own. Rather than use the money for the projects, Middaugh is alleged to have used the customers’ money for various unauthorized purposes unrelated to their projects.

Middaugh was also charged with four alternative counts of Theft by Unauthorized Taking (one for each project). The Theft by Unauthorized Taking counts allege that Middaugh obtained or exercised unauthorized control over $1,500.00 in deposits from each customer, and used the deposits that were authorized to be used in furtherance of the four construction projects for unrelated purposes, with a purpose to deprive the customers of their funds.

Middaugh is scheduled to be arraigned on the charges in Hillsborough County Superior Court – Northern District on May 6, 2024, at 9:00 a.m.

The indictments are merely accusations and Middaugh is presumed innocent until proven guilty.

This matter was investigated by Investigator Calice Ducey of the Department of Justice’s Consumer Protection and Antitrust Bureau. The case is being prosecuted by Assistant Attorney General JR Davis, also of the Consumer Protection and Antitrust Bureau.
