Contractor Receives Sentence of 1-3 Years in State Prison for Felony Theft

Concord, NH – Attorney General John M. Formella announces that Robert Lowry, age 57, has been sentenced for his conviction of Theft by Unauthorized Taking.  Lowry pleaded guilty to the charge in September of 2023.

The Hillsborough County Superior Court – Southern District sentenced Lowry to a stand-committed sentence of 1 -3 years in the New Hampshire State Prison for his theft of $37,250 from two individuals who hired him to perform renovations on their home.  In addition, the Court ordered him to pay $37,250 in restitution and enjoined him from soliciting or accepting any deposit for work not yet performed for the duration of his sentence.

In April of 2018, the victims contracted with Lowry to have him replace their home’s siding, upgrade its deck, and cut down three trees on their property.  They provided him with a 30 percent cash deposit to purchase materials and secure a starting date.  From April to May of 2018, the victims made a series of additional cash payments to Lowry for both change orders and payment towards the overall project.  Instead of using the money to purchase materials and perform the contracted-for improvements, Lowry stole it.  The extent of the work he actually performed consisted of hiring a subcontractor who cut down one of the three trees the victims had paid Lowry to cut down.

This case was prosecuted by Assistant Attorney General Zachary Frish and Senior Assistant Attorney General Brandon Garod of the Department of Justice’s Consumer Protection and Antitrust Bureau.  Investigator Calice Ducey, also of the Consumer Protection and Antitrust Bureau, investigated the case.
