Former Home Contractor Indicted on Multiple Counts of Felony Theft

Concord, NH – Attorney General John M. Formella announces that on Friday, November 17, the Belknap County Grand Jury returned three indictments charging Gerard Michael Healey, age 56, with two class A felony counts of Theft by Misapplication of Property and another class A Felony count of Theft by Unauthorized Taking or Transfer pursuant to one scheme or course of conduct.

The Theft by Unauthorized Taking or Transfer indictment alleges Healey stole over $1,500 pursuant to one scheme or course of conduct by soliciting and receiving deposits from eight customers who contracted with him to perform home renovation projects.  Rather than use the money for those projects, Healey is alleged to have used the customers’ money for various unauthorized purposes unrelated to their homes.

One Theft by Misapplication of Property indictment alleges Healey stole over $1,500 from R.C. upon agreement or subject to a known legal obligation to make a specified payment or distribution to a third person, and recklessly failed to make the required payment or disposition and dealt with the money as his own.

The other Theft by Misapplication of Property indictment alleges Healey stole over $1,500 from C.H. and T.H.  upon agreement or subject to a known legal obligation to make a specified payment or distribution to a third person, and recklessly failed to make the required payment or disposition and dealt with the money as his own.

The indictments stem from an investigation which previously led to Healey being charged with 19 misdemeanor counts alleging he collected customer deposits in violation of New Hampshire’s Consumer Protection Act. In total, Healey is accused of stealing just under $209,000.

Healey is scheduled to be arraigned on the charges in Belknap County Superior Court on December 19, 2023, at 9 a.m. The indictments are merely accusations, and Healey is presumed innocent unless or until proven guilty.

This matter was investigated by Investigator Frederick Lulka of the Department of Justice’s Consumer Protection and Antitrust Bureau.  The case is being prosecuted by Assistant Attorneys General JR Davis and Zachary Frish, also of the Consumer Protection and Antitrust Bureau.
