State v. Aaron Doleszny

Concord, NH – Attorney General John M. Formella announces that Aaron Doleszny, age 35, of Swanzey pleaded guilty and has been sentenced in the Sullivan County Superior Court to one felony count of Improper Asbestos Management.

The investigation in this case established that between March and July 2019, Mr. Doleszny completed work as a contractor in Charlestown, New Hampshire at a residence owned by an elderly adult. Prior to beginning work, the homeowner's daughter informed Doleszny that siding shingles on the residence contained asbestos. Nonetheless, Doleszny failed to contact the New Hampshire Department of Environmental Services prior to beginning work. Furthermore, Mr. Doleszny did not take precautionary measures to prevent asbestos fibers from entering the environment while completing the work and disposing of the material. Mr. Doleszny hired a 17-year-old to dispose of the asbestos material and New Hampshire State Police and the New Hampshire Department of Environmental Services became aware of the violations when an abandoned trailer containing asbestos shingles was discovered on the side of the road in Acworth.

The Court sentenced Mr. Doleszny to 12 months in the house of corrections, all suspended for a period of three years. The Court also ordered Mr. Doleszny to pay a fine of $2,500. Mr. Doleszny did not have to pay restitution because he previously paid for proper disposal of the asbestos materials after police and New Hampshire Department of Environmental Services became aware of the violations. He is also prohibited from engaging in asbestos abatement activities during the three-year suspension term.

This case was investigated and prosecuted by members of the New Hampshire Attorney General's Office Environmental Protection Bureau in conjunction with the New Hampshire State Police and New Hampshire Department of Environmental Services.
