Arrest of Hugh McIntyre for Assault of a Facility Resident

Concord, NH – Attorney General Gordon J. MacDonald and Rye Police Chief Kevin Walsh announce that Hugh McIntyre, age 69, of Greenland, was arrested April 2, 2019, and charged with simple assault in violation of RSA 631:2-a; sexual assault in violation of RSA 632-A:4; and abuse of a facility resident in violation of RSA 151:27. The charges were filed in Rockingham County Superior Court.

The charges allege that, on January 28, 2019, Mr. McIntyre fondled the breast of a woman living in a Rye long-term care facility's memory care unit. The offenses are class A misdemeanors. Each complaint alleges that Mr. McIntyre is subject to an extended term of imprisonment, under RSA 651:6, because he intended to take advantage of the 86-year old victim's age or physical disability. Mr. McIntyre entered a plea of not guilty and waived arraignment, which had been scheduled for April 19, 2019.

The charges and allegations are merely accusations. Mr. McIntyre is presumed innocent unless and until proven guilty.

The Rye Police Department and NH Department of Justice Medicaid Fraud Control Unit investigated the case, which is being prosecuted by Senior Assistant Attorney General Sean P. Gill. MFCU has jurisdiction to prosecute alleged patient and resident abuse or neglect in any board and care facility, whether or not the facility accepts Medicaid funding.
