Release of Video Footage and Dispatch Audio from the May 19, 2017 Officer-Involved Shooting of Bryan G. Evans in Hopkinton, New Hampshire

Attorney General Gordon J. MacDonald and State Police Colonel Christopher J. Wagner announce that the following records are being disclosed in connection with the May 19, 2017 officer-involved shooting of Bryan G. Evans in Hopkinton, New Hampshire: (1) video footage of the incident; (2) audio of the Merrimack County Sheriffs Department (MCSD) dispatch from the May 19, 2017 incident; and (3} still photographs from a private citizen's cell phone.

On May 25, 2017, a preliminary report (which is attached) was issued regarding this shooting which concluded that based on all the facts and circumstances New Hampshire State Police Trooper Michael Arteaga and New London Police Officer James MacKenna were each justified in the use of deadly force when each officer discharged his firearm at Mr. Evans.

The video footage and still photographs being released were obtained by consent from private citizens' cell phones. No footage of the incident was captured by police body cameras or cruiser cameras.

The video and audio recordings and the still photographs were not released at the time of the preliminary report because of the pending charges against Mr. Evans. The recordings were then the subject of a request under RSA ch. 91-A, the Right-to-Know Law. Mr. Evans and the Merrimack County Attorney's Office were given the opportunity to seek a court order to prevent their release. They declined to do so. Accordingly, the recordings and photographs are being made public today.

In addition to containing audio, video and images relevant to the incident, the audio, videos, and still photographs also contain private content. As such, the audio and videos have been redacted, as outlined below, to exclude both the audio of private conversations and video depicting private citizens. In addition, still photographs have been withheld which depict private citizens.

  • Clip 1 - audio redaction of private conversation from 0:40 to 2:00, from 2:20 to 2:50, and from 3:04 to the end of the video.
  • Clip 2 - audio redaction of private conversation from 0:00 to 1:07 and from 4:30 to the end of the video.
  • Clip 3 - audio redaction of private conversation for the entirety of the clip.
  • Clip 4 - video redaction of private citizens' faces occurring around 0:50.
  • Clip 5 - no redactions.
  • Clip 6 - audio redaction of private conversation for the entirety of the clip.
  • Clip 7 - audio redaction of private conversation from 0:00 to 0:50 and from 1:06 to the end of the video.
  • Clip 8 - audio redaction of private conversation from 0:19 to the end of the video.
  • Clip 9 - audio redaction of private conversation from 0:00 to 2:00 and 2:16 to the end of the video.
  • Clip 10 - audio redaction of private conversation from 0:00 to 0:32 and 0:48 to the end of the video.
  • Clip 11 - audio redaction of private conversation from 0:20 to the end of the video.
  • MCSD dispatch log MP3 Audio Format Symbol- registration number redacted from audio file.
  • 31 still photographs - 6 photographs are being withheld which contain depictions of private citizens.

No further information is expected to be released concerning this incident until the pending criminal case against Mr. Evans for his actions before, during and after the shooting incident, is concluded. Once Mr. Evans's criminal charges have concluded, the Attorney General's Office will issue a fully-detailed final report on this officer-involved shooting incident.

Discs containing the audio and video footage and the still photographs will be available to be picked up at the Office of the Attorney General,1 Granite Place South, Concord, New Hampshire.
