Clinton Turner Indicted for Accomplice to Second Degree Murder and Other Crimes Related to the 2018 July Murder of David Smith in his home in Nashua, New Hampshire

Concord, NH – Attorney General John M. Formella and Nashua Chief of Police Kevin Rourke announce that Clinton Turner (age 30), formerly of New Haven, Connecticut has been indicted by the Hillsborough County Grand Jury – Southern District in connection with the murder of David Smith (age 49) inside his home on the night of July 6, 2018, in Nashua, New Hampshire.

Mr. Turner was indicted for the following offenses against David Smith:

  • Second Degree Murder (Accomplice) – for aiding or acting in concert with Tramaine Poole and others to rob David Smith with a deadly weapon and helping to recklessly cause David Smith's death with extreme indifference to the value of human life when Tramaine Poole shot David Smith in the head;
  • Robbery (two alternative counts) – for using physical force against David Smith while he was aiding or acting in concert with Tramaine Poole and others to commit a theft from David Smith with a deadly weapon when David Smith was aware of such force, and (1) when Tramaine Poole was armed with a handgun; and also (2) when Tramaine Poole inflicted death upon David Smith by shooting him; and
  • Conspiracy to Commit Robbery – for agreeing with Tramaine Poole and others to rob David Smith, and then at least one of twelve separately alleged overt acts which occurred in furtherance of their conspiracy.

The Grand Jury also indicted Diana Hazard (age 32) for being an Accomplice to the Robbery of David Smith. In addition, two informations were filed charging Diana Hazard for the misdemeanor offenses of Conspiracy to Commit Theft and Theft against David Smith and his property on the night of the homicide.

Just after midnight on July 8, 2018, Nashua Police responded to a 911 call at 19 Buck Street for a reported deceased male. Upon arrival, they discovered David Smith, age 49, deceased inside his home. An autopsy the next day revealed that Mr. Smith's cause of death was a single gunshot wound and the manner of death was a homicide. The Nashua Police Department has continued to investigate this matter ever since.

As charged in the indictments, Tramaine Poole (age 41) of New Haven, Connecticut, was the person who shot and killed David Smith during the robbery. Mr. Poole died in an officer-involved shooting incident in Sussex County, Virginia on August 1, 2018, less than a month after David Smith's murder. During that incident, Mr. Poole suffered fatal gunshot wounds when he was fleeing from Virginia State Police officers in a stolen vehicle, and began firing a handgun at the pursuing officers. At the time of David Smith's murder, Mr. Poole had an active arrest warrant from New Haven, Connecticut for the murder of Tyequa Nesbitt (age 28) approximately one month before David Smith's murder.

Mr. Turner is currently being held without bail on separate charges. An arraignment on the indictments is expected to be scheduled in Hillsborough County Superior Court – Southern District in Nashua. A formal arraignment will also be scheduled for Ms. Hazard.

The charges and allegations set forth in the indictments and informations are merely accusations, and both Mr. Turner and Ms. Hazard are presumed innocent unless and until proven guilty.
