Contractor Thomas Gioseffi Indicted for Theft of Consumer's Money

Concord, NH – Attorney General John M. Formella announces the indictments of Thomas Gioseffi, age 67, of Hampton, New Hampshire, for one count of felony theft by unauthorized taking and one count of felony theft by misapplication. Mr. Gioseffi owns Genesis Builders, LLC., and Gio Realty, LLC.

The Rockingham County Grand Jury indicted Mr. Gioseffi on a Class A felony count of Theft By Unauthorized Taking. The indictment alleges that on or between November 11, 2019 and October 24, 2020, Mr. Gioseffi obtained or exercised unauthorized control over the property of D.C., specifically U.S. currency, with a purpose to deprive D.C. thereof, in an aggregate amount in excess of $1,500.

The Class A felony count of Theft by Misapplication alleges that on or between November 11, 2019 and October 24, 2020, Mr. Gioseffi obtained property, specifically U.S. currency, from D.C. upon agreement to make a specified payment to Groundhog Landscaping, whether from that property or its proceeds or from his own property to be reserved in an equivalent or agreed amount, and he recklessly failed to make the required payment to Groundhog Landscaping, and dealt with the property obtained or withheld as his own, the value being in excess of $1,500.

Class A felonies and are punishable by up to 7½ -15 years at the New Hampshire State Prison and/or a maximum fine of $4,000.

Indictments and complaints are merely accusations, and Mr. Gioseffi is presumed innocent unless and until proven guilty.
