Guilty pleas in State v. David McCarthy

Concord, NH – Attorney General Gordon J. MacDonald and New Hampshire Insurance Department Commissioner John Elias announce that David McCarthy of Alton, New Hampshire, pleaded guilty and was sentenced today in the Carroll County Superior Court, to one felony count of insurance fraud, and one felony count of witness tampering.

Between January 1, 2013 and February 28, 2015, Mr. McCarthy fraudulently billed both Cigna Corporation and Anthem, Inc., for chiropractic services that he did not render. When authorities began investigating the case, Mr. McCarthy attempted to cause one witness to provide false information regarding his provision of chiropractic service.

As a result of his criminal conduct, Mr. McCarthy was sentenced to concurrent 1 to 3 year sentences in the New Hampshire State Prison, all suspended, conditioned on good behavior and the full payment of $43,360.00 in restitution within 45 days.

This case was prosecuted by Assistant Attorney General Heather A. Cherniske and Assistant Attorney General Jesse O'Neill.
