New Hampshire Attorney General Gordon J. MacDonald announces that on January 5, 2018, a Rockingham County Grand Jury indicted Janet Delfuoco, age 50, of Northwood, New Hampshire, for violations of RSA 631:4-a. Ms. Delfuoco is scheduled to be arraigned in the Rockingham County Superior Court on February 2, 2018, at 1:00 p.m.
RSA 631:4-a makes it a class B felony to threaten to commit bodily injury or any other crime against a member of the judiciary in retaliation for action taken as a part of the judge's duties. Ms. Delfuoco is alleged to have retaliated against a Rockingham County Circuit Court judge and a Rockingham County Superior Court judge by posting statements to Facebook threatening to commit bodily injury or other crimes against them. She is also charged with the misdemeanor offense of criminal threatening in connection with Facebook statements threatening an attorney.
Each of the felony charges carries a maximum penalty of 3½-7 years of imprisonment and a $4,000 fine. The misdemeanor charge carries a maximum penalty of 1 year of imprisonment and a $2,000 fine.
The charges and allegations are merely accusations, and Ms. Delfuoco is presumed innocent unless and until proven guilty.
