Nashua Foundries, Inc., fined $50,000 for Violation of the Underground Storage Facilities Act
Attorney General Joseph A. Foster and Assistant Commissioner Clark Freise of the New Hampshire Department of Environmental Services ("NHDES") announce that the Hillsborough County Superior Court (Temple, J.) has approved a settlement between the State and Nashua Foundries, Inc. ("Nashua Foundries") resolving allegations of violations of the State's Underground Storage Facilities Act.
The State alleged that Nashua Foundries failed to properly maintain its underground storage tanks ("USTs") in working order; to repair or replace the cathodic protection system for one of its USTs; to permanently close UST's in disrepair; and failed to properly maintain various management, certification and training requirements for the USTs operators.
The alleged violations were resolved when Nashua Foundries removed all of its underground storage tanks.
Under the terms of the settlement, Nashua Foundries will pay a civil penalty of $50,000, payable in 25 installments of $2000/month until the penalty is paid in full.
