Registered Nurse Sentenced for Possession of Patient's Narcotic

Attorney General Joseph A. Foster announces that Alissa Durgin of Raymond, New Hampshire was convicted and sentenced on May 13, 2014 for possession of a prescription drug.

Durgin was employed as a registered nurse at Colonial Poplin, a nursing home in Fremont. In May 2012, she was found in possession of a fentanyl patch that was prescribed for a resident. Fentanyl is a narcotic pain medicine.

Durgin received a sentence of twelve months at the House of Corrections, deferred for one year and then suspended for one year. She will also be on probation for two years. As part of this sentence, Durgin has agreed not to obtain employment that involves direct patient care or access to controlled drugs.

The case was prosecuted by the Medicaid Fraud Control Unit, which investigates both healthcare provider fraud and allegations involving abuse and neglect of nursing home residents. The Board of Nursing issued an emergency suspension of Durgin's license on June 7, 2013.

Attorney General Foster said "My office will continue to investigate and vigorously prosecute caregivers who use their professional positions to obtain controlled drugs."
