Attorney General Joseph A. Foster announces that waivers of indictments charging Raymond C. Prouty with one class A felony count of theft by unauthorized taking and one class A felony count of theft by deception have been filed in the Merrimack County Superior Court today. The waivers provide:

1. Between July 28, 1998 and January 31, 2012, Raymond C. Prouty did commit the crime of theft by unauthorized taking in that, pursuant to one scheme or course of conduct, he did purposely exercise unauthorized control over U.S. Currency having an aggregate value greater than $1,500.00, the property of Southern New Hampshire University, with a purpose to deprive the owner thereof.
2. Between September 29, 2009 and June 9, 2012, Raymond C. Prouty did commit the crime of theft by deception, in that, pursuant to one scheme or course of conduct, he did obtain U.S. Currency having an aggregate value greater than $1,500.00, the property of Southern New Hampshire University, by deception and with a purpose to deprive the owner thereof, in that, Raymond C. Prouty created a business named Only the Best OPS, an entity that was under the his sole control, and which received financial payments from Southern New Hampshire University due to Raymond C. Prouty having created the false impression that the money paid to Only the Best OPS was then being used solely for the payment of officials for Southern New Hampshire University sporting events, an impression which was false and which Raymond C. Prouty did not believe to be true, in that, Raymond C. Prouty actually used the Southern New Hampshire University funds that had been paid to Only the Best OPS to pay his personal debts.

An arraignment as well as a plea and sentencing hearing have been scheduled for February 25, 2014 at 9:00 a.m. in the Merrimack County Superior Court.

The State will not be providing any further information regarding these charges until that plea and sentencing hearing.
