Acting Attorney General Bud Fitch issued the following statement: Based upon an initial review of the Superior Court’s Order regarding the New Hampshire Medical Malpractice Joint Underwriting Association (“JUA”), the State will file an appeal of today’s Order to the New Hampshire Supreme Court. The State recognized from the time the case was filed by the Petitioners that the Supreme Court would ultimately be asked to rule upon the constitutionality of the Legislature’s action.

The State looks forward to presenting its argument as to why the legislation is constitutional.
