Attorney General Kelly A. Ayotte and Special Agent-in-Charge Michael Hubbard of the United States Environmental Protection Agency’s Criminal Investigation Division announce that on Friday, June 19, 2009, Brett P. Berube (Age 36) of Kingston, NH was charged with three misdemeanor offenses relating to violations of New Hampshire’s Waste Disposal laws. The charges allege that Mr. Berube, a licensed septic system installer, knowingly failed to install a septic system in accordance with the design plan that had been approved by the Department of Environmental Services (“DES”); falsely represented to DES that a septic system he installed was ready for inspection when he knew the system did not meet the requirements of the approved design plan; and knowingly installed a septic system within an area where such installation was prohibited due to its proximity to an operational well.

The charges are the result of a cooperative investigation involving the New Hampshire Attorney General’s Office, the United States Environmental Protection Agency’s Criminal Investigation Division, and the New Hampshire Department of Environmental Services.
