Kingston Corporation Pleads Guilty to Criminal Charges for Environmental Violations

Concord, NH – Attorney General John M. Formella and the N.H. Dept. of Environmental Services (“NHDES”) Commissioner Robert Scott announce that Torromeo Industries, Inc. (“Torromeo”) pled guilty to two misdemeanors for unlawfully altering terrain by placing fill in two areas, including areas containing wetlands, on its property in Kingston.

Torromeo uses the property to manufacture and sell sand, gravel, stone, and concrete. Torromeo was previously subject to civil enforcement actions for violating environmental laws and rules.

In 2020, NHDES received a complaint that Torromeo was engaging in tree clearing, grading, and expanding the northeasterly face of a quarry on the property. A subsequent NHDES and New Hampshire Department of Justice (“NHDOJ”) investigation determined that areas had been unlawfully altered including two wetlands that had been filled with sand and stone. Between 2018 and 2021, Torromeo placed approximately 20-30 vertical feet of fill in a 0.1 acre palustrine forested wetland and 450 linear feet of intermittent stream channel located on the northeasterly face of the quarry. Between 2016 and 2020, Torromeo placed approximately 50-75 vertical feet of fill in 0.63 acres of palustrine scrub/shrub wetland and 380 linear feet of stream channel. The wetland fill significantly altered the characteristics of the terrain so as to impede natural runoff or create unnatural runoff on the property.

Once contacted by State investigators, Torromeo worked with NHDOJ to resolve these charges and achieve compliance with New Hampshire’s environmental rules and laws.

Torromeo agreed to a $100,000 fine on each offense, with $25,000 of each fine suspended for a period of five years. The remaining $150,000 will be paid in two installments. The conditions of suspension include hiring a certified wetlands scientist to delineate wetlands on the site, assess stabilization of the fill material, and perform wetland restoration as approved by NHDES. Torromeo will also coordinate bi-annual inspections and apply for an after-the-fact alteration of terrain permit.
