The Department of Justice has received numerous inquiries about the status of the investigation into the death of Wayne Martin, Jr. on Wednesday, March 2, 2011. Mr. Martin died of a gunshot wound as a result of an officer involved shooting in Concord. The Department of Justice, working with the assistance of the New Hampshire State Police Major Crime Unit, routinely investigates all officer involved shootings that result in death to determine whether the use of deadly force by any law enforcement officer was justified under the law.
Attorney General Delaney stated: "My office and the New Hampshire State Police Major Crime Unit have been working diligently during the past two weeks to review the circumstances surrounding this shooting. Despite these diligent efforts, I am disappointed to report that we have been unable to advance our investigation to a point where we have adequate information to determine whether or not this shooting was justified under the law. We are committed to taking all necessary steps to complete a full and comprehensive investigation. At this stage, I regret that I do not anticipate having a substantive update anytime soon."
