Veterans Museum of NH

Attorney General Michael A. Delaney issues the following consumer alert to the citizens of New Hampshire:

Nonprofit organizations soliciting donations in the State of New Hampshire are required to register with and report to the Attorney General. Veterans Museum of New Hampshire, a nonprofit, charitable organization, has not registered with the Attorney General's Charitable Trusts Unit despite repeated requests to file the required documentation. As a result Veterans Museum of New Hampshire is in violation of New Hampshire law, including, but not limited to, RSA 7:28, I (registration requirements), RSA 7:28, II (reporting requirement), RSA 7:28, VI (breach of trust), and RSA 7:28-f (penalties).

On August 10, 2009, a request was made to Veterans Museum of New Hampshire regarding the registration requirement under New Hampshire law. The Museum was soliciting donations in the Town of Boscawen. Despite the assurances of Henry Pratte, the founder, a registration application was not filed with the Charitable Trusts Unit. After several written, telephone and e-mail exchanges with Mr. Pratte, the Charitable Trusts Unit issued a "cease and desist" letter on April 28, 2010, prohibiting Mr. Pratte and the Museum from soliciting donations until registration was finalized with the Unit. After several additional contacts with the Attorney General's Office, Mr. Pratte filed the application for registration on July 15, 2010. By letter dated August 10, 2010, the Museum was informed of several deficiencies in the application. To date, these deficiencies have not been addressed.

Attorney General Delaney, through Director of Charitable Trusts, Anne Edwards, is considering pursing legal action in the Hillsborough County Superior Court to compel Veterans Museum of New Hampshire to register with and report to the Charitable Trusts Unit. In accordance with New Hampshire law, penalties could include $10,000 for every violation of the charitable registration and solicitation laws of the State of New Hampshire.

Attorney General Delaney asks potential donors to exercise extreme caution before donating to the Veterans Museum of New Hampshire and, if any citizen receives a request for donations from this organization, please notify the Charitable Trusts Unit at (603) 271-3591 immediately.
